ourselves flirting with trouble in terms of confidentiality and all that it
entails. Do we understand just what “confidential communication” is?
What is and is not the “Mental Health record?” Who gets to see the mental
health record and who does not? What are “personal notes” and who can see
them? What about HIPAA and what must we absolutely do with our electronic
data? Are we using release of information forms appropriately?  In this interview,
Attorney Jonathan Nye, will provide helpful and legal guidance to answer these questions and many more to help you protect your patients and your practice.

Author Bio

Jonathan Nye, JD practices extensively in the areas of mental health and
human services law. The Nye Law Group, Ltd, has
developed a philosophy of assisting human services providers in avoiding
litigation, maintaining confidentiality, and managing their practices with
insight into the potential legal pitfalls inherent in the practice of human
services provision.
Mr. Nye is a graduate of the John Marshall Law School, licensed to practice
law in the State of Illinois and before the Federal Courts of the Northern
District of Illinois. He has lectured before the Illinois State Bar Association,
the Chicago Bar Association, local and national associations related to law
and human services as well as numerous mental health, developmental
disabilities and alcohol and drug abuse agencies.
